Subcontractors Information Exchange
and Business Practice Interchange
“Negotiating GC Contract Revisions”
Tuesday, January 14, 2020
11:30am-2:00pm “Lunch & Learn”
This session will be followed by an optional, members-only Business Practice Interchange
555 Fairmount Ave.
Towson, MD 21286
Join Bruce Kauffman, one of the leading construction attorneys in Maryland, as he leads a “mock” subcontractor negotiation with a general contractor.
Bruce will present practical advice for the subcontractor on how to be effective when negotiating with a general contractor to revise contract provisions that shift an unfair amount of risk to the subcontractor. This program will provide subcontractors with essential strategies to be successful in negotiating contract provisions such as flow down, payment, scheduling, and delay damages. When these strategies are implemented correctly, the subcontractor will secure a reasonable allocation of the risk between the subcontractor and general contractor in the performance of the subcontractor’s work.
Bruce E. Kauffman’s construction practice concentrates exclusively on the representation of subcontractors and suppliers, and he frequently speaks to the construction industry. Mr. Kauffman counsels clients on the importance of risk management and subcontract negotiation to avoid unfavorable terms, achieve project profitability, and protect against litigation. He has also successfully prosecuted numerous mechanic’s liens, payment bond claims, and related construction and commercial claims.
Mr. Kauffman also specializes in corporate and estate and trust law, and provides counsel to business owners, including matters such as employment contracts, structuring complex corporate transactions, and mergers and acquisitions.
OPTIONAL BPI SESSION FOR MEMBERS ONLY: Immediately following this session, we will facilitate a Business Practice Interchange (BPI) to provide participants with an opportunity to exchange experiences regarding industry business practices (payment habits, job safety, scheduling, contract terms, etc.) of general contractors, owners, developers and construction management firms.
